Amusement Park Accidents and Liability

Its summertime and the amusement parks are filled to capacity. While theme parks can be a great source of fun and entertainment, they also present various risks to their park patrons. Roaring roller coasters, adrenaline-packed shows, and “trained” animals can all be potential personal injury hazards. According to the Consumer Protection Safety Commission, serious injuries from amusement parks have risen to almost 5,000 a year. Other sources account for up to 11,000 amusement park injuries a year, but one thing is for sure, the numbers are continuing to rise. Also, between 1997 and 2002 there was an average of 5 deaths a year related to theme park hazards.

Some of the documented cases of amusement park injuries are:

Six Flags Kentucky Kingdom in Louisville- In June 2007, a 13 year-old girl had both of her feet severed on a ride.

SeaWorld Orlando- In August 2006 a 6 year-old boy from Georgia was bitten on the arm by a dolphin.

Busch Gardens Tampa – In July 2006, a 52 year-old man from Florida died after riding the Gwazi Tiger Coaster.

Disney World’s Mission: Space has reported 10 serious injuries, including death, since the ride opened in 2003.

In August of 1999, one of the last weeks of summer, 4 deaths occurred on roller coasters in just one week’s time. The U.S. News & World Report called it “one of the most calamitous weeks in the history of America’s amusement parks.”

So are the amusement parks responsible? Like most personal injury cases, it depends on a couple factors. In cases where the theme park took “reasonable care” in designing, maintain and managing the ride, the courts will not typically hold the park responsible. “Reasonable care” will generally deal with the danger level of the ride; more extreme rides will require more careful maintenance and supervision.

Other factors that affect a personal liability case include:

Any possible fault of the rider in causing their own injury

Any extraordinary or uncontrollable events that may have caused the injury

Any violations of inspection codes or regulations

Any previous accidents on the ride similar to the injury in question
